                                                   Terms and Conditions of Business


1. Families must complete our Family Registration Form and sign the Terms and Conditions and return both to the agency, before they are accepted as clients. Nannies can only be booked for family when all this documentation and full payment has been received. Should there be any delays or the documentation is not satisfactory, the agency reserves the right to cancel the placement at any stage. 


2. Link Chinese Limited ('Company') acts as an agent to introduce suitable candidates to work as nannies, maternity nurses/nannies, Au Pairs, Cleaners and babysitters ('Applicant') for it's Clients ('Client'). The company does not employ any of the applicants, directly or indirectly.


3. Clients undertake to notify the Company immediately upon any offer being made which results in the engagement of an Applicant.


4. Fees charged relate to one engagement only. If an Applicant subsequently rejoins the Client at any time in the future, the Client undertakes to inform the Company and pay the relevant introduction fee again.


5. Accounts must be paid within ten days of the invoice date. Failing to do so, the engagement may be cancelled and a late payment fee will apply, that is an additional 10% surcharge on each re-invoice which may occur every 7 days.


6. All engagement fees quoted are exclusive of Applicant's salary and other chargeable expenses of the applicant and/or Company.


7. In the case of overseas Clients, payment must be made within ten days of the invoice date and in any event before the applicant leaves the U.K. to take up her/his position.


8. In the case of the cancellation of any engagement by the Client, half the full fee is payable with respect to that Applicant shall be payable by the Client.


9. The full fee from the engagement date shall be payable by the Client, even though any awaited birth may be delayed.


10. Clients undertake to notify the Company if any Applicant for a temporary position remains with the Client, and in such event an additional full fee for a permanent introduction appropriate to the Applicant shall be payable by the Client.


11. All introductions of Applicants by the Company and their personal details shall be kept strictly confidential by Clients. Clients undertake accordingly not to disclose any introductions to third parties. Any breach of this undertaking resulting in the employment of an Applicant by a third party renders the Client liable for full payment of the Company's introduction fee.


12. Clients agree to reimburse reasonable traveling expenses incurred by Applicants attending interviews.


13. R
efund Scheme:

If a Candidate engaged in permanent employment by the Client does not remain in the Client's employment for at least four weeks or has their employment terminated by the Client within four weeks of commencement, The Company will provide a refund of placement fee excluding a £200 administrative fee, if all the following conditions are met:-

a)      The Client notifies The Company within 2 business days of the Candidate’s termination.

b)      The Client paid The Company's placement fee in full within 10 days of the invoice date.

c)      The Client has not changed the Applicant's location of employment, the hours originally agreed by the Candidate and Client or the original job description and has provided the Candidate with an employment contract.

d)      The Client did not terminate the Applicant's employment or the Applicant did not resign due to unreasonable demands placed upon the Applicant's by the Client. 

e)      The Client has allowed the Company 4 weeks to recruit a suitable replacement Applicant to be engaged by the Client, commencing from the date the Client notified the Comany of the original Applicant's resignation or termination.


14. The Company uses its reasonable endeavours to establish the suitability of any Applicant for introduction to the Client. However, all responsibility for ascertaining the suitability of an Applicant for the engagement remains with the Client. The Company does not accept under any circumstances and excludes liability for any loss, damage, expenses, or delay incurred or suffered by the Client, the Clients family, servants, or the Client¹s assets, allegedly arising from the acts, omission or character of the Applicants introduced by the Company, or, to the extent permitted by law, in respect of services provided by the Company.


15. No variations to these terms of business, either express or complied, may be made without the written consent of a Director of the Company.


16. If our candidate is solicited to work for the client with the intention of bypassing the agency fees then the client will be invoiced a one off penalty fee of £500 on top of the invoice.


17. Terms and Conditions may be subject to change at any time and without notice, however all changes will be posted on our website. It's your responsibility to check these Terms and Conditions in case there are any changes. Continuing to use the site and our services after a change has been made is your acceptance of the changes.


18. These terms of business are covered by English law and all disputes arising out or in connection therewith shall be subject to the jurisdiction of the English courts.
